Welcome to Service1. By engaging our services or accessing our website at service1.app, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
1. Services
Service1 provides digital advertising and lead generation services for local home service businesses. Our services include but are not limited to:
- Google Ads and Meta (Facebook/Instagram) campaign creation and management
- Conversion-optimized landing page design
- Lead tracking and reporting via our proprietary Source Lock technology
- Ongoing campaign optimization and performance management
- Dedicated account management and support
2. Client Eligibility
Our services are designed for established home service businesses. By engaging our services, you represent that you operate a legitimate business and have the capacity to fulfill the leads and jobs generated by our campaigns.
3. Ad Account Ownership
You retain full ownership of and access to your advertising accounts (Google Ads, Meta Business Manager, etc.) at all times. We manage campaigns within your accounts on your behalf. If our engagement ends, your accounts, campaign history, and data remain yours.
4. Payment Terms
Our services require two components:
- Ad spend: Paid directly to the advertising platforms (Google, Meta, etc.). We do not mark up ad spend.
- Management fee: Billed monthly in advance for our campaign management services. Fees are outlined in your service agreement.
Late payments may result in pausing of campaigns. Management fees are non-refundable except as required by law or as described in our 30-Day Guarantee.
5. 30-Day Guarantee
If your ad revenue in your first 30 days with us does not exceed the revenue from your previous 30 days, your next month of service is on us — no management fees. This guarantee applies to new clients only.
6. Client Responsibilities
To ensure the success of your campaigns, you agree to:
- Respond to leads promptly — ideally within minutes, not hours
- Provide accurate business information, service areas, and pricing
- Maintain sufficient staffing and capacity to handle the volume of leads generated
- Communicate changes to your services, availability, or budget in a timely manner
- Provide access to necessary accounts and platforms as needed
7. Results Disclaimer
While we have a strong track record of generating quality leads and revenue growth for our clients, individual results vary based on factors including market conditions, competition, service area, ad budget, and your team's ability to convert leads into booked jobs. Case studies and performance metrics referenced on our website are for illustrative purposes only and do not constitute a guarantee of specific results.
8. Intellectual Property
Ad creatives, landing page designs, campaign strategies, and other materials we produce during our engagement are created for your use. Our proprietary tools, methodologies, and software (including Source Lock) remain the intellectual property of Service1 and may not be copied, reverse-engineered, or distributed.
9. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive business information shared during the engagement, including campaign performance data, business financials, and strategic plans. This obligation survives termination of our agreement.
10. Termination
Either party may terminate the service agreement with 30 days' written notice. Upon termination:
- Active campaigns will be paused or transitioned as agreed
- You retain full ownership of your ad accounts and all associated data
- Outstanding fees for services rendered through the termination date remain due
- Access to our proprietary tools and reporting dashboards will be discontinued
11. Limitation of Liability
To the maximum extent permitted by law, Service1 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenue, arising from our services. Our total liability shall not exceed the management fees paid by you in the three months preceding the claim. We are not liable for actions taken by third-party advertising platforms, including account suspensions, policy changes, or ad disapprovals.
12. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after changes take effect constitutes acceptance of the revised terms.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Service1 operates, without regard to its conflict of law provisions.
